SAN JOSE – A San Jose software developer alleges a Minnesota individual and corporation are selling pirated and counterfeit versions of its software.
Adobe Systems Inc. filed a complaint on Nov. 8 in the U.S. District Court for the Northern District of California against Chukoula LLC, Gaoxing Yang and Does 1-10 alleging trademark infringement and other counts.
According to the complaint, the plaintiff alleges that Chukoula LLC, Gaoxing Yang and Does 1-10 allegedly imported, offered, advertised, promoted, retailed, sold, and/or distributed counterfeit and/or unauthorized Adobe-branded software bearing plaintiff’s trademarks. The plaintiffs hold the defendants responsible because they allegedly deceived and misled consumers into believing that items being offered for sale by them are authorized products.
The plaintiff requests a trial by jury and seeks judgment against defendants, award profits from infringement, restitution, damages, injunction, attorneys' fees, costs of suit and further relief as the court deems just.
