LOS ANGELES – A woman alleges a debt collector called her more than 100 times after she revoked her consent for it to contact her.
Stefanie S. Dost filed a complaint on Nov. 8 in the U.S. District Court for the Central District of California against Citibank NA and Does 1 to 10 citing the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that beginning in May, she suffered damages from receiving several collection calls from the defendant in an attempt to collect an alleged debt. She alleges she revoked her consent for the defendant to call her in June, but the defendant has called her 110 times since that request. The plaintiff holds Citibank NA and Does 1 to 10 responsible because the defendant allegedly used an automatic telephone dialing system to call plaintiff's cellular telephone.
The plaintiff requests a trial by jury and seeks statutory damages of $1,000, actual damages, all legal fees and any other relief as the court deems just. She is represented by Stuart Price of Price Law Group APC in Encino.
