LOS ANGELES – A Los Angeles-based labor union trust fund alleges a Las Vegas employer has failed to pay contributions.
Construction Laborers Trust Funds for Southern California Administrative Co. filed a complaint on Nov. 9 in the U.S. District Court for the Central District of California against Chapman's Welding Inc. citing the Employee Retirement Income Security Act and the Labor Management Relations Act.
According to the complaint, the plaintiff alleges that Construction Laborers Trust Funds for Southern California Administrative Co. suffered damages due to unpaid and late paid contributions since December 2014. The plaintiff holds Chapman's Welding Inc. responsible because the defendant allegedly breached their bargaining agreement with the plaintiff by failing to make monthly benefit contributions on behalf of their employees and has also failed to let the plaintiff perform an audit.
The plaintiff seeks sum of at least $2,606.63 in damages plus interest, damages including contributions, liquidated damages, all legal fees and any other relief as the court deems just.
