SACRAMENTO – The exclusive licensee of a brand of smoker's pipes alleges a Roseville store is selling counterfeit versions of its products.
Sream Inc. filed a complaint on Nov. 15 in the U.S. District Court for the Eastern District of California against Soniya Valley LLC and Does 1-10 alleging trademark infringement.
According to the complaint, the plaintiff alleges that since August 2013, it has been the exclusive licensee of the RooR Mark in the United States, a brand known to manufacture premier smoking glass water pipes. The plaintiff alleges the defendants are selling counterfeit RooR goods without consent from plaintiff. The plaintiff holds Soniya Valley LLC and Does 1-10 responsible because the defendants allegedly used marks that were confusingly similar to federally registered RooR marks, and passed off such counterfeits as authorized products from RooR.
The plaintiff requests a trial by jury and seeks judgment against the defendants, profits and statutory damages of up to $2 million, attorney's fees, costs of suit, to enjoin defendants from further infringement and further relief as the court may deem just.
