Modesto man accused of using infringing copy of Live Face on Web software

SACRAMENTO – A Pennsylvania software developer alleges a Modesto individual is using its product without permission.

Live Face on Web LLC filed a complaint on Nov. 15 in the U.S. District Court for the Eastern District of California against James E. Jacobson and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it is a software company specializing in borderless video technology and is the developer and owner of a “live person” software. It alleges that the defendant used and distributed, without permission, the infringing version of the plaintiff's code on its own website, which caused plaintiff to suffer diversion of trade, loss of profits, injury to goodwill and reputation, and the dilution of the value of its rights. The plaintiff holds Jacobson and Does 1-10 responsible because the defendants allegedly failed to acquire permission from plaintiff to use its software and gained profit at the expense of plaintiff.

The plaintiff requests a trial by jury and seeks judgment against defendants, permanent injunction, damages, account all profits, income, receipts or other benefits derived by defendant, attorneys’ fees, costs and further relief as the court may deem just.
