LOS ANGELES – Two Los Angeles garment vendors are accused of selling clothing with infringing fabric patterns.
Jitrade Inc. filed a complaint on Nov. 17 in the U.S. District Court for the Central District of California against Design of DK Inc., doing business as Cube Plus and Cube Instyle; Humming Fashion LK Inc., doing business as Mint Choco Wholesale; and Does 1-10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Design of DK Inc., doing business as Cube Plus and Cube Instyle; Humming Fashion LK Inc., doing business as Mint Choco Wholesale; and Does 1-10 responsible because the defendants allegedly created a design that was identical or similar to plaintiff's design JIC-22 and incorporated it into their garments that they sold to consumers.
The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's design, award the plaintiff all profits, statutory damages, all legal fees and interest plus any other relief as the court deems just.
