Unicolors Inc. alleges dress was made from copyrighted textile design without authorization

LOS ANGELES – The copyright owner of a black-and-white textile design alleges the design was used on a dress without its permission.

Unicolors Inc. filed a complaint on Nov. 15 in the U.S. District Court for the Central District of California against Princess of NY Inc., doing business as Riva USA, Danice Stores Inc. and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Princess of NY Inc., Danice Stores Inc. and Does 1 through 10 responsible because the defendants allegedly copied plaintiff's MG1175 design and incorporated it into a dress that they sold to consumers.

The plaintiff requests a trial by jury and seeks enjoin the defendants from further infringing plaintiff's design, award all profits and damages to the plaintiff, statutory damages, all legal fees and interest plus any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs, Trevor W. Barrett, and Justin M. Gomes of Doniger/Burroughs in Venice.
