LOS ANGELES – Two truck drivers allege they were misclassified as independent contractors by their Mississippi-based employer and have filed a class-action suit.
Shawn Etienne and Angelo Grant filed a complaint on behalf of all others similarly situated on Nov. 14 in the U.S. District Court for the Central District of California against KLLM Transport Services LLC and Does 1 through 50 alleging violation of California labor codes.
According to the complaint, the plaintiffs allege that they worked without being paid wages equal to the total hours worked. The plaintiffs holds KLLM Transport Services LLC and Does 1 through 50 responsible because the defendants allegedly failed to pay any overtime premium to the plaintiffs for working more than 40 hours, failed to pay a minimum wage, failed to provide timely and accurate wage statements and other counts.
The plaintiffs request a trial by jury and seek unpaid minimum wages, payment of all business expenses, restitution and disgorgement, actual damages, interest, all legal fees and any other relief as the court deems just. They are represented by Joshua H. Haffner and Levi M. Plesset of Haffner Law PC in Los Angeles.
