SAN DIEGO – A Los Angeles bobble head manufacturer alleges a San Diego real estate company is selling counterfeit Donald Trump bobble heads.
Plan P2 Promotions LLC filed a complaint on Nov. 14 in the U.S. District Court for the Southern District of California against Wright Brothers Inc., Corey Wright and Casey Wright alleging copyright infringement.
According to the complaint, the plaintiff alleges that it designs, markets, distributes, licenses and sells bobble heads, including a specific design which is known as the Donald Trump Red Hat Bobblehead. It alleges that the defendants have infringed on its work and starting Oct. 20, the plaintiff sent numerous take-down requests to internet services that sell defendants' work. The plaintiff alleges that upon receiving its notices, the defendants disguised their unlawful act by advertising a revised bobble head version but still shipping the original infringing version.
The plaintiff requests a trial by jury and seeks judgment against defendants, injunctive relief, impound all counterfeit products, constructive trust, general, special, actual, and statutory damages, costs of action, attorneys' fees and additional relief as is just.
