SAN FRANCISCO – A Torrance business alleges its patented juicer design is being used by a Wisconsin company and its subsidiaries.
Breville USA Inc. filed a complaint on Nov. 21 in the U.S. District Court for the Northern District of California against Spectrum Brands Holding Inc., Spectrum Brands Inc. and Russell Hobbs Inc. alleging patent infringement.
According to the complaint, the plaintiff alleges that on April 28, 2015, it was duly and legally issued a patent registration '196 for a fruit and vegetable juicer that has a motor above titled Compact Juicer. It alleges the defendants have been manufacturing, marketing, selling, importing and/or using an accused product without permission or license from the plaintiff. The plaintiff holds Spectrum Brands Holding Inc., Spectrum Brands Inc. and Russell Hobbs Inc. responsible because the defendants alleged actions have caused it irreparable harm.
The plaintiff requests a trial by jury and seeks judgment in its favor, declare infringement by defendants, award damages, plus interest and costs, and further relief as the court may deem just. It is represented by Bruce E. Copeland and Shady E. Joulani of Nixon Peabody LLP in San Francisco.
