Phone 05

LOS ANGELES – A Los Angeles County resident alleges that a pharmacy chain continues to send unwanted text messages.

Jalen Epps filed a complaint on Nov. 21 in the U.S. District Court for the Central District of California against Walgreen Co. and Does 1-10 alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff withdrew consent from receiving texts from the defendant earlier this year. The plaintiff alleges the defendant continues to send text messages. The plaintiff holds Walgreen Co., and Does 1-10 responsible because the defendants allegedly used an automatic telephone dialing system to send text messages to the plaintiff.

The plaintiff seeks statutory damages, all legal fees and any other relief as the court deems just. The plaintiff is represented by Scott J. Ferrell and Victoria C. Knowles of Pacific Trial Attorneys in Newport Beach.
