Akeso Health Services claims Michigan company is selling infringing versions of its MigreLief product

LOS ANGELES – A Westlake Village dietary supplement maker alleges Michigan company is making, selling or offering to sell its migraine relief product.

Akeso Health Sciences LLC filed a complaint on Nov. 30 in the U.S. District Court for the Central District of California, Western Division against H&H Wholesale Services Inc. alleging patent infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business as the result of the infringement of its '999 and '450 patents. The plaintiff holds H&H Wholesale Services Inc. responsible because the defendant allegedly offers for sale plaintiff's MigreLief which infringes at least one claim of plaintiff's patents.

The plaintiff requests a trial by jury and seeks pay the plaintiff actual damages, lost profits, increased damages of three times the compensatory damages, all legal fees and any other relief as the court deems just. It is represented by Shawn G. Hansen of Nixon Peabody LLP in Los Angeles.
