Universal North America Insurance Co. alleges dryer sold by Sears caused house fire

MCKINLEYVILLE – An insurance company is seeking damages after a fire in a Eureka home that it alleges was caused by a dryer.

Universal North America Insurance Co., as subrogee of Ronald and Beverly Garrido, filed a complaint on Nov. 30 in the U.S. District Court for the Northern District of California, Eureka Division against Electrolux Home Products Inc. and Sears Roebuck & Co. alleging strict products liability design defect and other counts.

According to the complaint, the plaintiff alleges that on Dec. 2, 2013, Ronald and Beverly Garrido's home was damaged because of a fire that started from a clothes dryer that was manufactured by Electrolux and distributed by Sears. As a result, plaintiff was obligated to pay over to its insureds more than $75,000 for damages to property caused by the fire loss, the suit states.

The plaintiff holds Electrolux Home Products Inc. and Sears Roebuck & Co. responsible because the defendants allegedly failed to design a product that is safe to use by consumers and failed to warn consumers of the potential risks and dangerous condition associated to defendant's product.

The plaintiff requests a trial by jury and seeks judgment against defendants, damages and all other just and equitable relief. It is represented by Lee M. Mendelson, Martin F. Goldman, Marc A. Schwarz of Mendelson Goldman & Schwartz PC in Sherman Oaks.
