SAN FRANCISCO – Former sales representatives for a cable company have filed a class-action suit alleging violations of labor laws.
Andre Scott, Ken Fassler and Elijah Maxwell-Wilson filed a complaint on behalf of themselves all others similarly situated on Nov. 30 in the U.S. District Court for the Northern District of California against Comcast Cable Communications Management LLC and Does 1-50 alleging failure to provide for meal periods, failure to pay hourly wages and other counts.
According to the complaint, the plaintiffs allege that they were employed by the defendants. While they typically worked for at least 55 hours per week, they allege they were not paid for any overtime hours worked or provided proper meals and rest periods. The plaintiffs hold Comcast Cable Communications Management LLC and Does 1-50 responsible because the defendants allegedly misclassified employees as exempt from overtime, failed to provide employees with the proper meal and rest breaks, failed to provide minimum/overtime wages, failed to timely pay all final wages of discharged or resigned employees and failed to keep an accurate record of employees' hours worked.
The plaintiffs request a trial by jury and seek judgment against defendants, appoint class representative and counsel, unpaid wages, actual and liquidated damages, restitution, declaratory relief, interest, statutory penalties, civil penalties, costs of suit, attorneys' fees and further relief as the court deems just.
