Union alleges AC Paving breached bargaining agreement

SAN FRANCISCO – An Oakland business is accused of not permitting a labor union to audit its records.

Board of trustees of The Laborers Health and Welfare Trust Fund for Northern California, et al. filed a complaint on Dec. 1 in the U.S. District Court for the Northern District of California against Vincent Logan, doing business as AC Paving, alleging breach of collective bargaining agreement.

According to the complaint, the plaintiffs allege that they and the defendant entered into a bargaining agreement on May 3, 1991, which allowed the plaintiffs access to the defendant's books for auditing purposes. The plaintiffs hold Logan, doing business as AC Paving, responsible because the defendant allegedly failed to fulfill its obligations under the agreement by failing to permit an audit of his records.

The plaintiffs request a trial by jury and seek judgment against defendant, submit to an audit of books, unpaid contributions, additional accrued interest, and liquidated damages, and further amounts, costs of suit, attorneys’ fees, and for such other further relief as the court may deem just.
