Condo owner claims Clean Earth Carpet is demanding payment when she didn't sign contract

SAN DIEGO – A La Mesa woman that owns a residential condominium alleges an El Cajon company attempted to collect payment for a contract between it and a third party.

Bita Pargol filed a complaint on Dec. 9 in the U.S. District Court for the Southern District of California against Clean Earth Carpet Inc., doing business as Clean Earth Restorations, and Parker Stanbury LLP alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Jan. 22, 2016, her home was damaged because the unit above her own suffered a water leak. The suit states the unit owner responsible for the damages sought out and contracted defendant Clean Earth to repair both units, however, the defendants insisted that plaintiff owed them money for the repairs although plaintiff was not responsible for hiring or contracting the defendants. The suit states the alleged debt was assigned to Parker for collection. The plaintiff holds Clean Earth Carpet Inc. and Parker Stanbury LLP responsible because the defendants allegedly demanded payment from plaintiff for a contract entered by a third party, and caused plaintiff to retain and pay for counsel.

The plaintiff requests a trial by jury and seeks judgment against defendant, actual and statutory damages, costs of litigation and attorney’s fees. She is represented by Jessica R. K. Dorman, Esq. and Robert L. Hyde of Hyde & Swigart in San Diego.
