SAN DIEGO – A San Diego man alleges two debt collectors tried to collect an amount that was not authorized.
Sam Devine filed a complaint on Dec. 9 in the U.S. District Court for the Southern District of California against The Judge Law Firm ALC and Stonecrest Village Master Association citing violations of the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that on November 2012, he was alleged to have incurred certain financial obligations to Stonecrest for Homeowner's fees. Around November 2012, the suit states the alleged debt was assigned to JLF for collection, while upon instruction of Stonecrest, JLF filed a case against plaintiff, where it obtained default judgment for the amount of $1,357.39, including damages, costs, and interest except attorney's fees. After the judgment, the suit states JLF attempted to collect more fees for additional correspondence or for payment plans. The plaintiff alleges the defendants did not have the right to collect more fees after the judgment.
The plaintiff requests a trial by jury and seeks judgment against defendants, actual, treble and statutory damages, costs of litigation and attorney's fees. He is represented by Jessica R. K. Dorman of Hyde & Swigart in San Diego.
