Nurse claims Anthem Life Insurance Co. wrongfully terminated disability benefits

SAN DIEGO – A registered nurse alleges she is disabled and that her insurer wrongfully terminated her disability benefits.

Kathy Edmonston filed a complaint on Dec. 19 in the U.S. District Court for the Southern District of California against Anthem Life Insurance Co. and Does 1-10 citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on Sept. 21, 2014, she became disabled and received disability benefits from the defendant that commenced on Jan. 28, 2015, to April 6, 2015, until the defendant denied further benefits on Nov. 18, 2015.

The plaintiff holds Anthem Life Insurance Co. and Does 1-10 responsible because the defendants allegedly failed to have the plaintiff examined, failed to address her low scores on exams and other counts.

The plaintiff seeks judgment against defendants, damages, interest, attorney's fees and costs. She is represented by Bernard R. Schwam of Law Office of Bernard R. Schwam in Encino.
