SAN DIEGO – A San Diego business alleges a Tennessee company owes it more than $300,000 for services it provided.
Xifin Inc. filed a complaint on Dec. 15 in the U.S. District Court for the Southern District of California against Anesthesia Services Associates PLLC, doing business as Comprehensive Pain Specialists, alleging breach of contract.
According to the complaint, the plaintiff alleges that on Oct. 2, 2015, it entered into a contract with the defendant, wherein plaintiff was to provide services using an internet-based accounts billing system it has developed. The plaintiff alleges it has suffered damages in the amount of $342,373.89 in unpaid service fees and finance charges.
The plaintiff holds Anesthesia Services Associates PLLC responsible because the defendant allegedly failed to fulfill its obligations under contract despite having received and benefited from plaintiff's systems and services, and failed to pay all amounts due.
The plaintiff requests a trial by jury and seeks judgment against defendant, damages in the amount of $342,373.89, interest, costs of suit and further relief as the court deems just. It is represented by John D. Hershberger and Christopher Beal of Dillon Gerardi Hershberger Miller & Ahuja LLP in Carlsbad.
