SACRAMENTO – A Tulare County mother alleges a medical center's negligence caused her minor son to break his arm.
Christina Cabrera and Josiah Cabrera filed a complaint on Jan. 4 in the U.S. District Court for the Eastern District of California against The United States of America alleging that negligence.
According to the complaint, the plaintiffs allege that on May 6, 2014, Christina Cabrera brought her minor son, Josiah Cabrera, to Valley Health Care Network operated and funded by the defendant for a medical examination. She alleges the medical staff attending to her son abandoned the young child without securing him on the examination table, thus causing him to fall off the table and break his arm.
The plaintiffs hold The United States of America responsible because the defendant's staff allegedly and failed its duty of care to safeguard and protect its patient.
The plaintiffs request a trial by jury and seek judgment against defendant; compensatory, general, and special damages in the amount of $250,000 and $75,000; costs of suit, and further relief the court deems just.
