Life Alert claims Bay Alarm Medical is unlawfully using mark

LOS ANGELES – A Los Angeles County business that provides emergency medical response services for seniors claims a competitor is using its marks to sell personal emergency systems.

Life Alert Emergency Response Inc. filed a complaint on Jan. 12 in the U.S. District Court for the Central District of California against Bay Alarm Medical LLC and Does 1-10 alleging trademark infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Bay Alarm Medical LLC and Does 1-10 responsible because the defendants allegedly continued to use plaintiff's mark for their business despite plaintiff's demand to cease using its mark.

The plaintiff requests a trial by jury and seeks enjoin the defendants from further infringing plaintiff's trademark, all profits and damages, treble damages, statutory damages, all legal fees plus interest and any other relief as the court deems just. It is represented by Ralph C. Loeb of Krane & Smith APC in Encino.
