A California-based company is embroiled in a legal battle against an individual accused of fraudulent activities involving significant financial misconduct. UNI SF VII, LLC filed a complaint on February 25, 2025, in the Superior Court of California, County of San Francisco, targeting Daryl Scott Friedman and unnamed defendants for their alleged roles in a complex scheme to defraud creditors.

The lawsuit centers around accusations that Friedman profited from his cousin Gregory Malin's financial downfall. According to the complaint, Malin had previously been found guilty of breaching fiduciary duties and engaging in fraud by Judge David A. Garcia (Ret.) in a related case, Chanter et al. v. Malin et al., which resulted in a $50 million judgment against him and his associated entities. The plaintiff claims that Malin and Friedman conspired to hide assets through undervalued property sales and deceptive loan transfers to prevent creditors from collecting debts owed by Malin’s entities.

The plaintiff alleges that on May 22, 2024, Malin sold real estate below market value to Friedman while acting as both the seller's representative and Friedman's agent, earning a commission on the transaction. Furthermore, it is claimed that shortly after a debtor examination in December 2024, Malin transferred interest from a loan to Friedman under questionable circumstances. These actions allegedly left the company unable to collect funds due to them.

UNI SF VII seeks several forms of relief from the court: nullification of fraudulent transfers under the Uniform Voidable Transactions Act, establishment of a constructive trust over proceeds obtained through these transactions, injunctions against further asset disposition by defendants, appointment of a receiver for transferred assets, general and special damages including punitive damages, attorney fees, and other equitable relief deemed appropriate by the court.

Representing UNI SF VII are attorneys Kyle A. Withers and Margaret T. Cardasis from Lubin Olson & Niewiadomski LLP. The case is presided over by Judge David A Garcia (Ret.), with Case ID CGC-25-622733.
