Individual claims Genpact Services called to solicit business without consent

SACRAMENTO – A Placer County resident has filed a class action against a collections agency over allegations of unlawful calls.

Xuandao Gray-Lingle filed a complaint individually and on behalf of all others similarly situated on Jan. 16 in the U.S. District Court for the Eastern District of California against Genpact Services LLC and Does 1-10 alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that on May 2016, the defendants called to sell or solicit its business without any prior express consent. The plaintiff holds Genpact Services LLC and Does 1-10 responsible because the defendants allegedly engaged in an unlawful practice of using an autodialer to place calls to the plaintiff's cellular phone and without prior express consent to place the calls.

The plaintiffs request a trial by jury and seek judgment against defendant, $500 in statutory damages for each violation, treble damages of up to $1,500 for every violation, and all other relief that the court deems just.
