Consumer files suit over collection calls from Charter Communications Inc.

SACRAMENTO – An Alturas individual alleges a debt collector continued to call her after she requested the calls stop.

Amanda Nagy filed a complaint on Jan. 18 in the U.S. District Court for the Eastern District of California against Charter Communications Inc. alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that she was harmed and suffered significant amount of anxiety, frustration and annoyance from receiving incessant calls from the defendant in its attempt to collect an alleged debt. She alleges she demanded the calls stop in May 2016, but they did not.

The plaintiff holds Charter Communications Inc. responsible because the defendant allegedly engaged in an unlawful practice of using an autodialer to place calls to cellular phones and without prior express consent to place the calls.

The plaintiff requests a trial by jury and seeks judgment against defendant, statutory damages of $500 for each violation, treble and actual damages, costs of litigation, attorneys' fees, punitive damages, and further relief as may be just.
