Man claims Bluegreen Vacations Unlimited did not have permission to call him

SACRAMENTO – A Bakersfield man alleges his privacy was invaded by a vacation company.

Kyle Miles filed a complaint on Jan. 20 in the U.S. District Court for the Eastern District of California against Bluegreen Vacations Unlimited Inc. and Does 1-10 alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in July 2016, he suffered damages from receiving numerous calls from the defendant in its attempt to solicit plaintiff to purchase defendant’s services. The suit states the plaintiff's number is listed on the National Do-Not-Call Registry. The plaintiff holds Bluegreen Vacations Unlimited Inc. and Does 1-10 responsible because the defendants allegedly engaged in an unlawful practice of using an autodialer to place calls to cellular phones and without prior express consent to place the calls.

The plaintiff requests a trial by jury and seeks judgment against defendant, treble damages, $1,500 and $500 in damages for every violation, and all other relief that the court deems just.
