Friend Trusted alleged to have sent text messages without permission to consumer

SAN FRANCISCO – A Kentucky woman alleges a Menlo Park business sent her unwanted text messages.

Heather Proffitt filed a complaint on Jan. 19 in the U.S. District Court for the Northern District of California against Friend Trusted Inc. alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that starting in 2016, she was harmed through invasion to her privacy, intrusion into her seclusion, interruption on her use and enjoyment of her cellular telephone and wastes of valuable time upon receiving numerous automated text messages from the defendant in its attempt to market gosmith.com. The plaintiff holds Friend Trusted Inc. responsible because the defendant allegedly failed to acquire prior express consent from her to send out messages and unlawfully utilized an automatic telephone dialing system.

The plaintiff requests a trial by jury and seeks judgment against defendant, actual and statutory damages, costs, attorney's fees, interest, and further relief as the court may deem just. She is represented by Matthew A. Rosenthal of Westgate Law in Los Angeles.
