La Mesa Billiards alleged to have unlawfully allowed performances of songs

SAN DIEGO – The owners of Jolt N Joes in La Mesa are alleged to have allowed the performance of certain musical compositions without a license.

Universal Music Corp., Jay E's Basement, Jackie Frost Music Inc., D2 Pro Publishing, Sam Swap Publishing, Tarpo Music Publishing, Young Dude Publishing, Notting Dale Songs, WB Music Corp., Music of Windswept, and Blondie Rockwell filed a complaint on Jan. 31 in the U.S. District Court for the Southern District of California against La Mesa Billiards LLC and Philip Paccione citing copyright infringement.

According to the complaint, the plaintiffs allege that the defendants failed to pay license fees through American Society of Composers, Authors, and Publishers (ASCAP) to publicly perform plaintiffs' licensed intellectual properties. The plaintiffs hold La Mesa Billiards LLC and Paccione responsible because the defendants allegedly failed to receive permission from plaintiffs to give such performances, and did not pay license fees to legally use plaintiffs' properties at Jolt N Joes.

The plaintiffs request a trial by jury and seek judgment in favor of plaintiffs, restrain defendants from further infringement, statutory damages of not more than $30,000 or less than $750 for every violation, costs of action, attorney's fee, and further relief as may be just.
