Consumer claims Samsung TV malfunctioned, could not get replacement parts

SAN FRANCISCO – A Marin County consumer alleges that she purchased Samsung television and that the company failed to make available parts needed to repair it.

Victoria Tulipani filed a complaint on behalf of herself and all others similarly situated on Feb. 1 in the U.S. District Court for the Northern District of California against Samsung Electronics America Inc. and Does 1-100 alleging violation of the Song-Beverly Consumer Warranty Act and other counts.

According to the complaint, the plaintiff alleges that she purchased a television manufactured by the defendants and that its main board later needed to be replaced after it began to malfunction. She alleges she was repeatedly told the part wasn't available. The plaintiffs hold Samsung Electronics America Inc. and Does 1-100 responsible because the defendants allegedly failed to make available the necessary replacement parts and failed to replace the defective product or return the amount paid.

The plaintiffs request a trial by jury and seek judgment against defendants, actual damages or reimbursement, attorneys' fees, costs, restitution, injunctive relief, and further relief as the court may deem proper.
