A shocking case of alleged medical negligence has surfaced, raising questions about the quality of care provided by a prominent healthcare organization. Austiag Hormoz Parineh filed a complaint against Kaiser Foundation Health Plan, Inc., Kaiser Foundation Hospitals, and The Permanente Medical Group in the Superior Court of California, County of Santa Clara on April 21, 2025. The lawsuit accuses these entities of failing to properly perform an appendectomy over three decades ago.

The roots of this legal battle trace back to the summer of 1992 when Parineh, then a 12-year-old boy residing in Santa Clara County, underwent an appendectomy at a Kaiser Hospital. Fast forward to January 2024, Parineh was diagnosed with stump appendicitis—a condition caused by the incomplete removal of the appendix during his childhood surgery. "For over 30 years, Plaintiff believed that all portions of his appendix had been removed," states the complaint. This revelation led to another surgical procedure on January 25, 2024, to remove the remaining portion of his appendix.

Parineh alleges that the defendants' negligence caused him severe pain and emotional distress while incurring substantial medical expenses. The complaint further accuses the defendants of failing to conduct necessary pathological analysis and laboratory examinations on the removed portion of his appendix in 1992. As a result, Parineh is seeking damages exceeding $85,000 for general and special damages along with costs incurred due to this alleged malpractice.

The plaintiff argues that each defendant was acting within their scope as agents or employees during the original surgery and subsequent care. This legal action is timely filed under California Code of Civil Procedure § 340.5 as Parineh discovered the negligence only in January 2024 and served a Notice of Intent to Commence Action for Professional Negligence in January 2025.
