SAN FRANCISCO – A pharmaceutical company with headquarters in San Francisco claims it has not been paid for goods it delivered.
McKesson Corp. filed a complaint on Feb. 1 in the U.S. District Court for the Northern District of California against Lifetime Rx Inc., Genesis Rx LLC and Charles Bree alleging breach of contract and other counts.
According to the complaint, the plaintiff alleges that between May and September 2016, it and Lifetime Rx entered into a series of agreements for the purchase of pharmaceutical goods. The plaintiff holds Lifetime Rx Inc., Genesis Rx LLC and Bree responsible because the defendants allegedly failed to fulfill their obligations under written agreement by refusing to pay for invoiced products and incurred interest on past due amounts.
The plaintiff requests a trial by jury and seeks judgment against defendants for the sum of $569,228.35, together with interest and other fees and charges, attorneys' fees, costs of suit and further relief as the court may deem proper. It is represented by Scott O. Smith and Mancy Pendergrass of Buchalter APC in Los Angeles.
