Pacific Bell Telephone Co. employee alleges he is owed unpaid disability plan benefits

SACRAMENTO – A sales and service representative alleges his short-term disability benefits were unlawfully terminated.

Mario A. Nava filed a complaint on Feb. 10 in the U.S. District Court for the Eastern District of California against Pacific Bell Telephone Co., Sedgwick Claims Management Services Inc. and Does 1-10 citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he has suffered monetary damages from defendants' refusal to provide further disability benefits to him despite being forced to stop working due to debilitating pain and numbness and chronic depression. The suit states he became disabled in July 2015 and that the benefits were terminated in October 2015.

The plaintiff holds Pacific Bell Telephone Co., Sedgwick Claims Management Services Inc. and Does 1-10 responsible because the defendants allegedly failed to provide a full and fair review of plaintiff’s claim.

The plaintiff requests a trial by jury and seeks judgment in his favor, unpaid plan benefits, costs, attorneys’ fees, interest, and further relief as the court deems just. He is represented by Robert J. McKennon and Joseph S. McMillen of McKennon Law Group PC in Newport Beach.
