SACRAMENTO – A Citrus Heights smoke shop operator is alleged to have sold counterfeit water pipes and related items.
Sream Inc. filed a complaint on Jan. 30 in the U.S. District Court for the Eastern District of California against Shobi Inc. and Does 1-10 alleging trademark infringement, counterfeiting and other counts.
According to the complaint, the plaintiff alleges that it is the exclusive licensee of Roor, a German company that designs and manufactures leading smoker's products, in the U.S. It alleges it has suffered substantial damages to its business and reputation caused by defendants' unlawful conduct of advertising, selling and distribution of counterfeit products with inferior materials and inferior technology bearing similar marks as plaintiff.
The plaintiff holds Shobi Inc. and Does 1-10 responsible because the defendant allegedly is likely to cause confusion among consumers by offering counterfeit products and used the RooR marks without authorization.
The plaintiff requests a trial by jury and seeks judgment against defendants, profits and statutory damages of up to $2 million per defendants, profits trebled, attorney's fees, costs of suit, restitution, and any further relief as the court may deem just.
