SACRAMENTO – A Sacramento County woman alleges AT&T charged her for a service she did not use.
Susan Whiting filed a complaint individually and on behalf of all other similarly situated on Jan. 26 in the U.S. District Court for the Eastern District of California against the AT&T Corp. and Does 1-10 alleging violation of the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that the defendants charged her for using its internet equipment beginning in August 2016 and sent her collection letters. The plaintiff alleges she never used the defendants' equipment and instead used her own modem. The plaintiffs holds AT&T Corp. and Does 1-10 responsible because the defendants allegedly attempted to collect on a debt that was not authorized by law or any agreement, and used deceptive means in connection with the collection of debts.
The plaintiff requests a trial by jury and seek judgment against defendants, certify case as a class action, statutory damages of $1,000 for every class member, actual damages, attorneys’ fees, costs of suit, interest, and further relief as the court deems necessary.
