SAN FRANCISCO – A Washington company alleges a carrier damaged its shipment of apples during transport.
Legacy Trading LLC filed a complaint on Feb. 10 in the U.S. District Court for the Northern District of California against Mediterranean Shipping Co. SA and Mediterranean Shipping Co. (USA) Inc. citing the Carriage of Goods by Sea Act.
According to the complaint, the plaintiff alleges that in January 2016, it sustained substantial monetary losses upon defendant's delivery of plaintiff's shipment of fresh apples in damaged condition and completely frozen, against written contracts of carriage to deliver cargo in the same good condition as when received.
The plaintiff holds Mediterranean Shipping Co. SA and Mediterranean Shipping Co. (USA) Inc. responsible because the defendants allegedly failed to fulfill its obligations under the agreement, by failing to deliver cargo in good condition.
The plaintiff requests a trial by jury and seeks judgment in its favor, damages in the sum of $40,468.81, interest, costs of suit, and further relief as the court deems just. It is represented by Joshua E. Kirsch of Gibson Robb & Lindh LLP in San Francisco.
