LOS ANGELES – A South Korean textile converter alleges one of its designs was used for garments without its permission.

C & SM Int'l filed a complaint on Feb. 22 in the U.S. District Court for the Central District of California against A'Gaci LLC; TK Bros. Inc., doing business as Mio Wholesale; and Trendyufashion; and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business from having its textile design ART-0251 copied and used on other fabrics. The plaintiff holds A'Gaci LLC; TK Bros. Inc., doing business as Mio Wholesale; and Trendyufashion; and Does 1-10 responsible because the defendants allegedly distributed garments made out of fabrics that feature plaintiff's design.

The plaintiff requests a trial by jury and seeks enjoin the defendants, profits, statutory damages, interest, all legal fees and any other relief as the court deems just. It is represented by C. Yong Jeong and Amy Choe of Jeong & Likens LC in Los Angeles.
