One Way Funding alleged to have unlawfully called consumers for solicitation purposes

SAN DIEGO – A New York business faces a class-action suit over allegations it unlawfully called consumers to solicit its services.

Christopher Melingonis filed a complaint individually and on behalf of all others similarly situated on March 7 in the U.S. District Court for the Southern District of California against One Way Funding LLC, also known as Fast Funding, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that beginning on Feb. 21, the defendant called him to solicit its services without his permission. The plaintiff holds One Way Funding LLC, also known as Fast Funding, responsible because the defendant allegedly unlawfully utilized an automatic dialer and automated voice and contacted plaintiff without prior express consent.

The plaintiffs request a trial by jury and seek judgment against defendant, injunctive relief, statutory damages, and other relief the court may deem just. He is represented by Joshua Swigart and Kevin Lemieux of Hyde and Swigart in San Diego and Abbas Kazerounian of Kazerouni Law Group, APC in Costa Mesa.
