Prospect Financial Inc., Pintar Investment Co. accused of making unlawful calls

SAN DIEGO – A San Diego consumer alleges he received unwanted calls from two companies pitching real estate brokerage and investment consultancy services.

Jonathan Sapan filed a complaint on April 5 in the U.S. District Court for the Southern District of California against Prospect Financial Inc. and Pintar Investment Co. LLC alleging that they violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that, between April 30, 2015, and March 9, 2016, he received eight live calls on his home phone from the defendants. As a proximate result of defendants' intrusions, the plaintiff alleges he suffered damage of no less than 5 percent of his monthly phone bills for the said period. The plaintiff holds Prospect Financial Inc. and Pintar Investment Co. LLC responsible because the defendants allegedly made calls without express permission from plaintiff to call.

The plaintiff requests a trial by jury and seeks award of $500 for each violation and $1,500 for each willful violation of the TCPA, compensatory and punitive damages, attorney’s fees, costs of suit and such further relief as the court deems proper. He is represented by Christopher J. Reichman of Prato & Reichman APC in San Diego.
