SAN FRANCISCO – An insurer is seeking recovery of an amount it paid to settle claims after a house fire.
Rockhill Insurance Co. filed a complaint on March 28 in the San Francisco County Superior Court against Kurt Meiswinkel Inc. and Does 1 through 50 citing negligence and other counts.
According to the complaint, Van Acker Construction Association was a subrogor of the plaintiff and that the company was a general contractor for a residence in San Francisco. The suit states Kurt Meiswinkel Inc. was a drywall subcontractor during a remodeling of the property in 2007.
The suit states that a fire broke out at the property in 2015 and the plaintiff believes its cause was the use of combustible materials in the area of the fire insert. The plaintiff alleges it paid $245,000 to settle a claim on behalf of Van Acker.
The plaintiff holds Kurt Meiswinkel Inc. and Does 1 through 50 responsible because the defendants allegedly failed to properly construct and make sure that the fireplace in the subject property was free of any defects that could start a fire.
The plaintiff seeks sum of $245,000 plus statutory interest, all legal fees and any other relief as the court deems just. It is represented by Emmett E. Seltzer of Boornazian, Jensen & Garthe in Oakland.
