The shocking case of a young child nearly losing his finger at an airport escalator has brought to light serious allegations against the city and a maintenance company. On October 24, 2024, Xiomar Lacorazza, represented by his guardian Erica Braudy, filed a complaint in the Superior Court of California, County of San Francisco, against the City and County of San Francisco and KONE Inc., claiming negligence in maintaining safety standards at San Francisco International Airport.

The complaint outlines that on November 28, 2023, Xiomar Lacorazza suffered severe injuries when his finger was caught in an escalator at Terminal 2 of SFO Airport. The lawsuit accuses the City and County of San Francisco and KONE Inc. of failing to maintain the protective plate at the bottom of the escalator. This negligence allegedly resulted in missing teeth on the combplate, creating dangerous gaps that led to Xiomar's injury. The plaintiffs argue that this lack of maintenance posed a foreseeable risk and breached multiple safety obligations under California law.

The filing details several causes of action against both defendants. The first cause claims that the City and County allowed a dangerous condition on public property by not addressing the worn-out combplate. Another cause asserts vicarious liability for negligence by government employees who failed to inspect and maintain the escalator properly. Additionally, it accuses KONE Inc., contracted for maintenance duties, of negligent failure to repair or replace defective components as mandated by safety codes.

Xiomar's legal team is seeking damages exceeding $35,000 for physical and emotional harm caused by this incident. They demand general and special damages according to proof at trial, along with costs incurred during litigation. Furthermore, they seek prejudgment interest as permitted under specific civil procedures.
