Plaintiff Alleges Former Employer Pulmuone Foods USA Inc. Violated Labor Laws

Juan Becerra has filed a class-action lawsuit against his former employers, alleging widespread labor violations that could affect numerous employees. On October 21, 2024, Becerra lodged the complaint in the Superior Court of California for the County of Santa Clara against Pulmuone Foods USA, Inc., Pulmuone U.S.A., Inc., Nasoya Foods USA, LLC, and unnamed defendants.

Becerra claims that during his employment from August 2000 to July 2024 as a non-exempt hourly employee in California, his employers engaged in multiple illegal labor practices. These include failing to pay minimum and overtime wages, not providing legally required meal and rest periods, delaying final wage payments upon termination, issuing inaccurate wage statements, and not reimbursing necessary business expenses. The complaint further alleges that these practices were part of a systematic policy affecting all similarly situated employees.

The plaintiff asserts that the defendants' actions violate several sections of the California Labor Code and constitute unfair business practices under the California Business & Professions Code. Becerra's legal team argues that the defendants maintained control over employees' work conditions and failed to comply with state laws mandating fair compensation and working conditions. The lawsuit seeks various forms of relief including unpaid wages, statutory penalties, injunctive relief to prevent future violations, and attorney fees.

Represented by attorneys Molly DeSario, James Yoo, and Ruby Palomares from Wilshire Law Firm PLC, Becerra is seeking class certification for this lawsuit to represent all affected employees. The case is being overseen by Judge L. Ayala under Case No.: 24CV450003.
