SAN DIEGO – A San Diego County consumer alleges Cox Communications Inc. invaded his privacy with marketing calls.

Denniz Salazar filed a complaint on April 10 in the U.S. District Court for the Southern District of California against Cox Communications Inc. alleging that the defendant violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in March 2015, he purchased internet service from the defendant on a month-to-month basis. After the said purchase, plaintiff alleges he began receiving marketing calls on a daily basis using an automatic telephone dialing system while using an artificial or prerecorded voice from the defendant without his authorization to receive such calls.

The plaintiff requests a trial by jury and seeks up to $1,500 for statutory damages for each call, injunctive relief prohibiting such conduct any other relief that the court deems just and proper. He is represented by Joshua B. Swigart and Yana A. Hart of Hyde and Swigart in San Diego and Abbas Kazerounian of Kazerouni Law Group APC in Costa Mesa.
