Courier driver alleges he is owed unpaid overtime pay

RIVERSIDE – A Mira Loma man alleges his employer has misclassified him as an independent contractor.

Christopher Agrella, individually and on behalf of all similarly situated individuals filed a complaint on April 11 in the U.S. District Court for the Central District of California against Orange County Courier and Logistics LLLP and Subcontracting Concepts LLC alleging that the defendants violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he has worked for the defendants as a courier driver since December 2014 and is misclassified as an independent contractor. The plaintiffs holds Orange County Courier and Logistics LLLP and Subcontracting Concepts LLC responsible because the defendants allegedly failed to pay overtime compensation at a rate no less than one-and one-half times the regular rate and failed to provide meal breaks and rest periods.

The plaintiff seeks judgment for all damages, unpaid overtime pay, attorney fees and costs incurred, pre- and post-judgment interest and such further relief as the court deems appropriate.
