SAN FRANCISCO – An employee has filed a class action against a San Francisco County corporation over allegations she was misclassified as an independent contractor.
Carmen Francois filed a complaint on March 30 in the San Francisco County Superior Court against Braavos Inc., doing business as Bannerman, and Does 1 through 20 citing California labor codes.
According to the complaint, the plaintiff alleges that she worked for more than 40 hours without being paid any overtime compensation as a security guard. The plaintiff holds Braavos Inc. and Does 1 through 20 responsible because the defendants allegedly misclassified the plaintiff as an independent contractor and also failed to pay a minimum wage and failed to provide meal and rest periods.
The plaintiff requests a trial by jury and seeks compensatory damages and benefits, general damages, special damages, punitive damages, interest, all legal fees, and any other relief as the court deems just. She is represented by Jay R. Strauss and David C. Winton of Winton Strauss Law Group PC in Novato.
