LOS ANGELES – A Los Angeles County corporation alleges that one of its textile designs was unlawfully reproduced.
Fabric Selection Inc. filed a complaint on April 17 in the U.S. District Court for the Central District of California against Kellwood Co. LLC, Belk Inc., Dillard's Inc., Burlington Stores Inc., Von Maur Inc., Stage Stores Inc. and Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business as the result of its SE40148 fabric designs copied. The plaintiff holds Kellwood Co. LLC, Belk Inc., Dillard's Inc., Burlington Stores Inc., Von Maur Inc., Stage Stores Inc. and Does 1 through 10 responsible because the defendants allegedly sold fabrics or garments made out of fabrics that bear plaintiff's design.
The plaintiff requests a trial by jury and seeks injunction against the defendants, recall and destruction of all garments that bear plaintiff's designs, actual damages, profits, all legal fees and any other relief as the court deems just.
