BGSD Inc., Momo Baby Inc. accused of infringing UGG boot design

LOS ANGELES – A Goleta footwear designer alleges one of its boot designs was unlawfully copied.

Deckers Outdoor Corp. filed a complaint on April 18 in the U.S. District Court for the Central District of California against BGSD Inc., Momo Baby Inc. and Does 1-10, inclusive alleging trade dress and patent infringement.

According to the complaint, the plaintiff alleges that its UGG Bailey Button boot, to which it owns the design, patent and trade dress rights, was infringed by the defendants. The plaintiff alleges the defendants were not granted a license or any other form of permission to plaintiff's product with respect to its trademarks, design patent, trade dresses or other intellectual property.

The plaintiff seeks a recall of the infringing products, award for all damages, costs, attorney's fees and such further relief as may be just and proper. It is represented by Brent H. Blakely, Cindy Chan and Jessica C. Covington of Blakely Law Group in Manhattan Beach.
