SAN DIEGO – A Minneapolis artist claims a Laguna Hills corporation unlawfully used a silhouette of his sculpture of Bigfoot as a logo for apparel.
Cameron Gainer filed a complaint on April 13 in the U.S. District Court for the Central District of California, Southern Division against The Ketchum Group Inc., doing business as Outdoor Technology, alleging copyright infringement.
According to the complaint, the plaintiff alleges that his sculpture titled "Forest Through The Trees," to which he owns all rights, title, interest and copyright, was copied and used as the primary logo/design on variety of clothing items, including hats, shirts, sweatshirts and accessories, sold by the defendant.
The plaintiff holds The Ketchum Group Inc., doing business as Outdoor Technology, responsible because the defendant allegedly used the copyright material for widespread commercial use without authorization.
The plaintiff requests a trial by jury and seeks to be awarded monetary relief, prejudgment interest, attorneys' fees, costs of suit incurred, and such other further relief as the court deems just and proper. He is represented by David Martinez of Robins Kaplan LLP in Los Angeles.
