Former Dona Maria employees allege they are owed overtime

SAN FRANCISCO – Three Santa Clara County residents allege they were not properly paid for overtime work when they were employed by a restaurant.

Cesar Ledo, Miguel Ledo and Ricardo Choy Morey filed a complaint on behalf of putative plaintiffs on April 26 in the U.S. District Court for the Northern District of California against Guillermo Prado and Maria Prado, both individually and doing business as Dona Maria, citing state labor laws.

According to the complaint, the plaintiffs allege that they suffered damages from not being paid overtime wages or being provided any meal or rest breaks. The plaintiffs hold the defendants responsible because the defendants allegedly failed to pay for overtime work at a rate of time-and-one-half, failed to provide uninterrupted meal periods and other counts.

The plaintiffs seek compensatory damages, restitution, damages, interest of 10 percent on the unpaid overtime compensation and unpaid salaries, all legal fees and any other relief as the court deems just. They are represented by James Dal Bon of Law Office of James Dal Bon in San Jose.
