Virginia couple says home wrongfully foreclosed on, sold

SAN FRANCISCO — A couple is suing Caliber Home Loans, Inc. Quality Loan Service Corp. and Breckenridge Property Trust 2016 LLC, citing alleged breach of contract.

Chris Norris and Elizabeth Norris of Virginia filed a complaint on April 5 in the San Francisco County Superior Court against the defendants alleging that they refused to provide a good faith offer to the plaintiff regarding their dispute regarding a mortgage.

According to the complaint, the plaintiffs allege that they suffered damages from having their property wrongfully foreclosed. The plaintiffs hold the defendants responsible because they allegedly ordered a foreclosure sale to the plaintiff's property despite the dispute.

The plaintiffs seek to invalidate the foreclosure sale conducted on Jan. 24, 2017, order the defendant to record a notice of rescission of sale, as well as monetary damages, punitive damages, all legal fees and any other relief as this court deems just.
