State Farm Mutual Automobile Insurance Co. alleges it is owed more than $3,000 after collision

SAN FRANCISCO – An insurance firm is seeking reimbursement of amount it paid to insured in collision.

State Farm Mutual Automobile Insurance Co. filed a complaint on April 5 in the San Francisco County Superior Court against Arnel Musni, Terex Utilities Inc., doing business as Terex Equipment Services, and Does 1-40 seeking subrogation.

According to the complaint, the plaintiff alleges that in October 2015, its insured Anna Tobes' vehicle was struck by Musni, who was operating a vehicle owned by Terex Utilities Inc. The suit states the plaintiff paid $3,079.17 to Tobes and that it is entitled to its right of subrogation of that amount.

The plaintiff seeks sum of $3,079.17, interest, all legal fees and any other relief as the court deems just. It represented by Richard L. Mahfouz II and Shelby Poteet of Clerkin, Sinclair & Mahfouz LLP in San Diego.
