Pizza maker claims Nob Hill Cafe did not accommodate wheat allergy

SAN FRANCISCO – A former employee of a San Francisco restaurant alleges the business would not accommodate his allergy.

Juan Kauil filed a complaint on April 5 in the San Francisco County Superior Court against Perdix Inc., doing business as Nob Hill Cafe, and Does 1-10 alleging failure to pay wages, discrimination, retaliation and other counts.

According to the complaint, the plaintiff alleges that he was hired by the defendants as a pizza maker in 2000. The suit states that in late 2011 or early 2012, he started to suffer from respiratory issues and was later diagnosed as suffering from a wheat allergy in 2016. He alleges he requested accommodation to avoid contact with pasta fumes and flour, but the defendants did not provide it.

The plaintiff holds Perdix Inc., doing business as Nob Hill Cafe, and Does 1-10 responsible because the defendants allegedly also failed to pay all wages, failed to pay overtime, did not provide rest periods and failed to provide accurate wage statements.

The plaintiff requests a trial by jury and seeks compensatory and consequential damages, unpaid wages, interest, all legal fees, statutory damages, punitive damages and any other relief as the court deems just.
